News about the 2024 Restrictions Review Project

It is definitely feeling like Fall here in Sarasota and Three Oaks!

Thank you to all who attended the Special Meeting on Thursday, October 17th 2024, who voted or sent in their proxies. We had a wonderful turnout in person, as well as one of the largest voting/proxy collections. Your care, appreciation, and willingness to come together for the betterment of the entire neighborhood is spectacular. Thank you!

The Board did not receive the necessary 139 affirmative votes on either of the two items that were on the ballot. However, all votes and proxies received are viable for the next 90 days (from Oct 17, 2024). Therefore, the Board will reconviene in person in November with the hopes of receiving a majority vote in favor or not in favor of the proposed items.

The next Special Meeting meeting will take place on Thursday, Oct. 21st, 2024, at Abundant Life Church, 6461 Proctor Rd, Sarasota, FL, at 6:30pm EST.

If you or a neighbor have not yet voted or submitted your proxy, please return your completed proxy or come vote in person. Return the vote or proxy form by mail/scan and email to Capstone Association Managment.

Homeowners will be receiving via USPS Mail the proposed budget for 2025. A Board meeting will be held after the Special Meeting for the Board to vote on the 2025 Budget.

President’s Report: Aug 14, 2024: President, Linda Spoolstra, reported

Cepra Landscaping has replaced 74 viburnum shrubs around the perimeter of the walls. It will take awhile for them to reach the height of the mature shrubs but it looks better with the dead ones removed.

Due to the problem with not having a manager from Capstone with us at this meeting due to staff illnesses, Dylan Clement offered to reduce the cost of the holiday lighting to one-half. This was appreciated.

VP, Cantrel, advised that a letter has been prepared to be sent to the 16 homeowners with lots adjacent to the Preserve telling them about the work we are doing in the Preserve to address its maintenance according to county standards. The letter explains how we have marked the beginning of the Preserve and that they will be receiving individual letters with any violations that will need to be addressed. We have had steel rods put in where Britt Surveying put in wooden stakes so it is clear where the preserve begins. There is an 8 ½ feet buffer right after the lot line in which homeowners can have native trees and shrubs. Lots will have a sign at the 8 ½ foot mark.

Treasurer, Burgess, has been working on plans to invest some of the association’s Reserve Funds in CDs and reduce the number of bank accounts which we have (3 total). After a discussion, Bonti moved that we close the two Cadence accounts and the Regions account and put the money from these accounts into the American Momentum Reserve Checking Account, open an account with the Royal Bank of Canada Wealth Management and buy 6 CD’s that mature in 6 months, 12 months, 18 months, 24 months, 30 months and 36 months taking advantage of the interest rates that range from 4.5% to 5.15% currently. This will amount to about $200,000. The balance left in the Operating Account will be sufficient to cover expenses for the rest of the year.

It is now time to cast your votes for the proposed Amended and Restated Declaration of Restrictions that we hope will make Three Oaks an even better family neighborhood than it is now. Please, mark your calendars for Thursday, October 17th, 2024 at 6:30 pm for a Special Meeting for Homeowners to cast their vote on the Declaration of Restrictions hosted at Abundant Life Church, 6461 Proctor Rd, Sarasota, FL. This meeting will not be available on Zoom as attendance is required to vote or a completed proxy returned.

If you cannot attend in person, please return your completed proxy with your vote. (You can name anyone as a proxy, or if left blank, our president will cast your vote as you have indicated on your proxy form.) Return the proxy form by mail or scan it and email it to Capstone Association Management . For the revised Declaration of Restrictions to be approved, we need 139 “yes” votes from community members.

The Board will also have a secondary vote related to Leasing/Rentals in our community. This is a separate vote whose results will be added to the approved Declarations of Restrictions. The vote includes that new owners must wait one year after purchase before they can rent their homes and all owners shall not lease their home for less than six consecutive months.

A short Board meeting will be held after the Special Meeting for the Board to vote on the 2025 Budget.
